The suit for damages is not enough but criminal charges should be filed whether such lunatic decision of releasing the dam was done deliberately or through negligence.
A conviction would definitely make any would be trigger man to exercise his utmost diligence even if he would do it at gun point; I believe a courageous and prudent man would definitely sacrifice his own life rather than to do otherwise.
