Suing for the shutdown or decommissioning of San Roque dam and being able to prove it in a competent court is a useless exercise. The suit for damages will prosper but the outright closure instead of demanding remedies such as prioritizing the functions and completing the other components of the project for the protection of lives and properties such as the reregulating dams and the required hydraulic control structures will never be entertained by the court.
Of course, I am not a lawyer but normally a suit of this nature must first exhaust all administrative remedies before it is entertained by the courts.
