Thank you for sharing your land dispute and how the system work. You and Mr Ed Pontaoe brought up reality to our Forum and for that I am very grateful.
My wife had been in the sidelines on bringing a case against FilEstate for 3 lots in Cavite she had paid in full but the company could not deliver the title. The reason we were told is that the original owner of the land they had subdivided and part of the three lots they sold us reneged after demanding more monies from FilEstate. The case below is similar to our’s.
One case study I read. FilEstate sold a lot that was part of the highway. The buyer took them to court. Although FilEstate lost the case, the lot that the judge directed them as replacement still has not been given because it also had a disputed title of the original owner before they developed the hacienda. So assurance of winning a case may still take years.
I had talked to fellow Pinoys here in NJ and they told me about the slow grind of the courts in the Philippines. In fact one person from Cavite told me that their land dispute dated back to when his grandfather was still alive and now the case is being handled by the grandkid lawyer of the grandfather lawyer who first handled the case.
I could not believe the story so I had been pressuring my wife to talk to our family lawyers to pursue the case. Now I may be inclined to think twice about pursuing the case after what I read here in the Forum.
