THE Office of the Ombudsman has issued an order for San Carlos City Mayor Julier Resuello and three others to attend a clarificatory hearing on April 22 for a case that was originally filed in 2009 and revived in December last year.

The hearing will take place before the Graft Investigation and Prosecution Officer at the Office of the Ombudsman for Luzon in Diliman, Quezon City.

Resuello, who is running for reelection in May, said he is aware of the malversation and gross negligence charges, but noted that it is an old case that is just being brought up again for political reasons.

Alam ko naman na sila eh kasi yun ang sinasabi nila sa kampo nila eh, may kaso si Mayor Ayoy. Sila ang bumuhay. Yun yung 2009 pa na case eh,” he said in a phone interview.

The order for a hearing is in response to a case filed by the Commission on Audit (COA), represented by lawyer Alexander Juliano, along with Realyn Mauricio and Juniel Sadiasa as complainants.

The order was issued pursuant to the Rules of Procedure of the Office of the Ombudsman, according to the letter signed by Joaquin Salazar, director for Preliminary Investigation, Administrative Adjudication and Prosecution Bureau-A.

In addition to Resuello, those summoned are City Accountant Rosemarie Senting, former cashier IV Marilyn Soliven, and former city treasurer Leny Fermin.

The cases are docketed as OMB-L-C-NOV-24-0270 for Violation of Articles 217 and 218 of the Revised Penal Code and Section 3 (e) of Republic Act No. 3019, and OMB-L-A-NOV-24-0259 for Grave Misconduct, Gross Neglect of Duty, and violation of Section 89, in relation to Section 127 of Presidential Decree No. 1445.

The report from the COA consists of 76 pages prepared by the Special Audit Team, created pursuant to COA Office Order No. 2010-206 dated March 29, 2010. (Eva Visperas)
