Prosecutor dismisses complaint vs 4 city employees
THE motion for reconsideration with motion for inhibition filed by five opposition councilors over a resolution dismissed by the Dagupan City Prosecutor’s Office on September 16, 2024, for disturbance of proceedings against four emplo-yees of the city government was dismissed October 17, 2024.
It was signed by Assistant Prosecutor Lourey Lei Canadido and approved by City Prosecutor Ma. Victoria Datuin-Cabrera.
The complaint was filed by Councilors Alvin Coquia, Alipio Serafin Fernandez, Redford Christian Erfe-Mejia, Maria Librada Fe Reyna, and Marilou Lourdes Fernandez against Adelaida Bangsal, Omer Ballesteros, Randy Olegan and Rosevida Palanas, all employees of the Dagupan City government.
Canadido’s resolution stated that “nary an issue was set forth by them (complainants) to persuade this Office in reversing our assailed resolution, and considered the Motion for Inhibition filed by them as without merit,” stressing that “we believe we are fair and just in resolving the assailed resolution.”
The councilors alleged that while the Sangguniang Panlungsod (SP) was holding a special session on December 28, 2023, the respondents, together with others and along with Mayor Belen Fernandez, gathered outside the SP building, some holding placards, to press for the approval of a supplemental budget where their Special Recognition Incentive (SRI) and gratuity pay were included.
In their counter-affidavits, the respondents categorically denied the accusation and pointed out that the session actually proceeded without interruption. They said their actions were only motivated by a sincere expression of their sentiments regarding the inaction of the SP on their gratuity bonus.
At the end of that special session, no supplemental budget was passed as the complainant councilors and two others maintained it would be subjudice on their part to pass the requested supplemental budget having challenged the validity of the approval of the 2023 budget before the Regional Trial Court.
