VM Kua, minority dads seek DILG, DBM legal opinion

“NEW” AIP, ANNUAL BUDGET

THE legal opinion from the Department of the Interior and Local  Government and the Department of Budget and Management (DBM) regional offices were asked whether it is legal for the Sangguniang Panlungsod to pass two resolutions and two ordinances “rectifying” the already vetoed Annual Investment Program  (AIP) and the Annual Budget

The inquiry addressed separately to Directors Agnes de Leon and Rita Bansigan of the regional offices of the DILG and DBM, respectively, and both dated April 11, 2023 were made by Vice Mayor Bryan Kua, and the five  minority councilors,  Michael Fernandez, Jeslito Seen, Dennis Canto,  Marcelino Fernandez, president of the Liga ng mga Barangay; and Joshua Bugayong, president of the Sangguniang Kabataan Federation.

They inquired specifically whether the SP can still pass a resolution rectifying the already passed AIP and an approved ordinance authorizing the annual budget despite the fact both  “already passed the three (3) readings and have been formally transmitted to the City Mayor.

Enclosed in the letters of the six Dagupan City officials were:

  1. a) Resolution No. 8009-2023 (approving the Annual Investment Program of P1.16 billion) passed on March 28, 2023 (and) received by the City Mayor on April 5, 2023 at around 2:30 p.m.;
  2. b) Ordinance No. 2257-2023 passed on Mach 28, 2023, authorizing the Annual Budget (of P864.91 million) (and) received by the City Mayor on April 11, 2023 at around :10 p.m.;

Note: Above documents were subsequently vetoed by Mayor Belen Fernandez.

  1. c) Draft Resolution No. 6252 rectifying the entries in lieu of Resolution no. 8009, and approving the Annual Investment Program (AIP) of the City of Dagupan and its accompanying Integral Plans for Calendar Year in the amount of Two Billion One Hundred Eight-Eight Million, Fifty Four Thousand One Hundred Sixty-Six Pesos and Fifty Four Centavos (P3,188,754,166.54); and

(The new AIP was passed in a special session of the SP on April 12 on motion of Councilor Redford Erfe-Mejia, chairman of the finance and appropriations committee despite the fact that the City Secretary already informed the body that Mayor Belen Fernandez already vetoed approved resolution No. 8009-2023.)

  1. d) Draft Ordinance No. 0-822 entitled An Ordinance Rectifying and Readdressing Specific Items in the CY 2023 and Fiscal Year 2023 Local Expenditure Program of the City of Dagupan.

(The draft ordinance was calendared for second reading in the SP session on April 18 but was deferred after the majority learned that Mayor Fernandez submitted partial veto to Approved Ordinance 2257-2023 allocating P864.91 million annual budget of Dagupan). (Leonardo Micua)
