LGU executive orders not subject to SP review – VG Lambino

EXECUTIVE orders issued by mayors of component cities and municipalities in Pangasinan, especially during the pandemic, are not subject to review by the Sanggunian Panlalawigan.

This was stressed by Vice Governor Mark Lambino in answer to questions posed by Second District Board Member Von Mark Mendoza whether the SP can exercise its power of review on E.Os. of component cities and municipalities who maintained that it is specified in the local government code.

Mendoza initially proposed to direct all local government units to submit their E.O.s for review, thereby institutionalizing procedures in the issuance of the same by local chief executives.

Lambino clarified that only local ordinances enacted by their respective Sangguniang are subject to review; and only E.Os. issued by local chief executives contrary to provincial ordinances and programs of the provincial government will be reviewed.

He said a provincial resolution earlier passed by the SP authored by Second District and Majority Floor Leader Nestor Reyes asked local chief executives to submit copies of their  E.Os. to the office of the governor and the SP for information purposes only.

So far, Lambino said the secretariat has not called his attention about any E.O. issued by a mayor that is in conflict with a provincial ordinance or programs of the provincial government.

Fourth District Board Member Agerico Rosario shared with the opinion of Mendoza that E.O. need to be reviewed by the SP as some local executives may be abusing their power.

However, Provincial Legal Officer Geraldine Baniqued shared the opinion of Vice Governor Lambino that an E.O. doesn’t have to be reviewed by the SP but observed that not all LGUs are submitting copies of their E.O. to office of the Governor. (Leonardo Micua)
