Use, sale of vape products now prohibited in Dagupan

THE Dagupan City government has officially banned the use and sale of vaporized nicotine and heated tobacco products in public areas following the approval of a new ordinance by the Sangguniang Panlungsod.

During its regular session on November 3, the council passed Ordinance No. 2357-2025, also known as the “Ordinance Regulating the Use and Sale of Vaporized and Heated Tobacco Products in Dagupan City.” Authored by Councilors Jalice Cayabyab and Michael Fernandez, the measure aims to safeguard public health, particularly minors, and aligns with Republic Act No. 11900 or the Vape Regulation Law.

The ordinance prohibits the use of vape and heated tobacco products in public conveyances and enclosed public spaces such as schools, hospitals, government buildings, and establishments frequented by the public. It also bans the sale or display of such products within 100 meters of schools, youth centers, or any area commonly visited by minors.

Advertising, promotion, or sponsorship of these products in any form—including online platforms, billboards, and digital screens—is likewise not allowed. The sale and use of these items in public markets are also restricted, except in designated smoking zones.

Violators face varying penalties. Users will receive a warning and orientation on the first offense, a ₱500 fine or four hours of community service for the second, and a ₱1,000 fine or eight hours of service for the third.

For sellers or establishments, penalties include a ₱2,000 fine and a warning for the first offense, ₱3,000 and a seven-day suspension of business permit for the second, and ₱5,000 and revocation of business permit for the third. Advertisers will be fined ₱5,000 per violation.

The City Health Office, Public Order and Safety Office, and the Philippine National Police, in coordination with barangay officials, will enforce the ordinance. (Leonardo Micua)
