Missing man in Dagupan City found dead

A man who went missing for six days was found dead in a state of decomposition along the De Venecia Highway in Dagupan City on Monday, June 20.

The victim, Aaron Fernandez, 20 years old, a resident of Barangay Poblacion Oeste in Dagupan City, was last seen riding a car at around June 14, 9 p.m.  and was not seen since.

His remains were stumbled upon six days later .

Fernandez’s body was only identified through a scar sustained on his left forearm and his bracelet. Autopsy revealed the victim sustained a wound in his head, possible from blunt force trauma.

The police identified the suspect, the driver of the car Aaron rode on the night he went missing, and who during his interrogation admitted to the crime.

The police, however, said the suspect could no longer be arrested not only because

he did not sign an extrajudicial confession, and could no longer be subjected to inquest proceedings because the period of the commission of the crime already lapsed.

At the same time, a warrantless arrest can only be done if the person is about to commit, is committing in flagrante delicto, or has just committed a crime.

Since almost a week has passed since the said person of interest supposedly committed the crime, he can no longer be arrested and detained.

“He may only be arrested once the court finds a probable cause”, said a police officer whose name has been withheld.

The suspect was already arrested by PDEA operatives in 2017, but was released last year after availing a plea-bargaining agreement.
