Mayor rejects SB’s recommendation to suspend kapitan
A RESOLUTION of the Sangguniang Bayan of Mangaldan urgently recommending to Mayor Marilyn Lambino the implementation of the preventive suspension against Barangay Chairperson Melinda Morillo for 60 days was rejected by the mayor herself.
The resolution dated 17 December 2020 and signed by nine councilors and one abstaining stemmed from the complaint for Grave Misconduct filed by former Mayor Bona Fe Parayno against Morillo dated December 9, 2020 involving the collection of Barangay Permit Clearance fees which the SB already nullified in a previous resolution.
Those who signed were Councilors Joseph Emmanuel Cera, Joselito Quinto, Christopher Romero, Fernando Juan Cabrera, Maria Teresa Abalos, Aldrin Soriano, Joel Meneses, July Frialde and Michael Ervin Lomibao, the lone abstention was registered by Councilor Rolly Abalos.
Vice Mayor Pedro Surdilla Jr., as presiding officer, signed the resolution recommending to the mayor to execute the preventive suspension of Morillo, in effect granting the ex-parte motion filed by ex-Mayor De Vera on December 14, 2020.
Parayno filed the motion contending that there is a need for the issuance of preventive suspension against the respondent (Morillo) to deter her from continuing with the illegal acts complained of and to preserve the evidence and further, to prevent harassment of possible witnesses.
In passing the resolution, the SB was guided by DILG Opinion No. 23 s. 2011 dated June 10, 2011 that held the determination of the conditions upon which preventive suspension may be imposed under the law is exclusively vested with the Sanggunian concerned.
The resolution cited the ministerial duty of the Municipal Mayor to implement the preventive suspension directed by the SB in the latter’s exercise of its quasi-judicial power under Section 63 of the Local Government Code. (Leonardo Micua)
