CAO spares 63 illegal fish pens again

THE sixty-three illegal fish pens found in the city’s rivers, whose owners claim these are standing within their properties, have been spared anew from demolition by the City Agriculture Office despite the final deadline set by Mayor Belen T. Fernandez last October 30.

This was gleaned from a list submitted by the Office of City Agriculture Officer Emma Molina to The PUNCH that indicated the lot numbers where the fish pens are located, their total land area, and the total area of their properties under water and their respective locations.

Other illegal fish pen owners whose structures were removed, however, complained that the continued operation of the 63 illegal fish pens violate the city ordinance for which their pens were demolished.

“These pens must also be demolished for violating the city ordinance,” said one former fish pen owner who asked not to be identified. “There must be no sacred cows in the Fernandez administration,” The PUNCH source said.

Molina insisted she will await the validation of the claim by the city assessor’s office before enforcing the order of the mayor. Relative to this, Molina called on the concerned fish pen owners to submit proofs of ownership of their properties to her office.

In a PUNCH interview with City Legal Officer Vicky Cabrera last week, she said the order of Mayor Fernandez “is complete removal or demolition of all illegal fish pens on or before the deadline.”

She added that the ordinance does not make any exemption.

At presstime, the city legal office has not indicated whether complaints will be filed against owners of the fish pens who refused to dismantle their structures on the mayor’s order.

Earlier, City Assessor Roland Suni told the PUNCH that the titled properties are totally or partly under water, and therefore reverted back as part of the public domain by law, the owners are not willing to give up their claims to these properties unless their titles are cancelled through proper judicial process.

“Such a litigation process can take long,” Suni said.

A press release from the City Information Office quoted Molina as saying that after her office has cleared all navigational lanes in all coastal barangays of Dagupan, her office will set its eyes on fish pens still standing along banks of various rivers.

She said her office will cross-check the titles to be presented with the actual cadastral map of Dagupan rivers.

From July 2013 to October 27, or three days before the deadline set by Mayor Fernandez, the CAO and the Bantay Ilog Task Force reported that 664 units covering a total land area of 97.96 hectares scattered over navigation zones have already been dismantled. (Leonardo Micua)
