Kapitana dismissed for grave misconduct, dishonesty

THE barangay chairman of Barangay Herrero-Perez in Dagupan City was dismissed from service after being found guilty of serious dishonesty and grave misconduct. 

Marilyn Mendoza was dismissed from her post by the Office of the Deputy Ombudsman for Luzon after deciding on the case filed by Anita Tiongson against the village chieftain on January 8, 2015.

She was meted “dismissal from service with the accessory penalties of cancellation of eligibility, forfeiture of retirement benefits, perpetual disqualification from holding public office and bar from taking civil service examinations.”

Tiongson was Herrero-Perez East’s former Barangay Treasurer until her service was terminated by Mendoza.

In her complaint, Tiongson averred that Mendoza caused undue injury to the government in the amount of P848,000 when she purchased a mini-dump truck for P1,198,000 when in truth and in fact, this was purchased for only P350,000.

Mendoza, on the other hand, contented that a resolution was unanimously approved by the barangay council, for the purchase of the same and that invitation to bid was duly published and public bidding was conducted with Zerk Trading as the only bidder.

Mendoza asserted that the mini-dump truck was not overpriced and it was in perfect condition when the barangay acquired it.  

On March 12, 2015, an audit report by the Commission on Audit noted that Mendoza owned the dump truck that was later acquired by the Barangay on February 14, 2014. She was ordered to refund the payment for the motor vehicle’s registration amounting to P4,849.06 be refunded because it was an irregular disbursement by the barangay.

On September 24, 2015, the Ombudsman rendered a decision that Mendoza acted in bad faith in the procurement of the vehicle; that there was deceit and damage to the government when Mendoza made it appear that the subject vehicle was owned by a private individual; that there was a deliberate intent to violate the law or flagrant disregard of established rules and the presence of additional element of corruption, thus making respondent liable for Grave Misconduct.

The decision was issued through a memorandum dated November 13, 2015 from the Office of the Undersecretary Austere Panadero.

The Ombudsman also cited serious dishonesty on the part of Mendoza because by staging a fake bidding, there appeared to be concealment or distortion of truth.

The Ombudsman’s decision was “immediately executory.”

Last Nov. 25, Barangay Kagawad Levy Tirao Sr. assumed the post as the new barangay captain.

The assumption order was served by DILG Region 1 Legal Officer Joseph Apologia and City Mayor Belen Fernandez later administered Tirao’s oath of office. (Johanne R. Macob/CIO)
