Mangaldan PNP files charges vs Kapitan, kagawad

USURPATION OF AUTHORITY, RESISTING ARREST

MANGALDAN– The barangay captain and councilwoman in barangay Poblacion here were charged with usurpation of authority, resisting arrest and assault on authorities by the Mangaldan Police Station (MPS) following an incident inside the barangay hall last December 3.

P/Supt. Jackie Candelario, chief of MPS, said the incident happened when his office received an order from Mayor Bonafe Parayno to verify the information that Barangay Chairman Joselito Quinto and Barangay Kagawad Melinda Morillo continue to remain in their office, discharging their functions despite the 60-day preventive suspension imposed by the Sangguniang Bayan (SB).

“We went in the barangay hall last week and confirmed that they indeed resumed their office, we already warned them to wait until the preventive suspension was lifted before they assume their post but they did not heed our request”, said Candelario.

“Quinto and Morillo became hysterical and hurled threats against the police officers,” said Candelario.

A video clip of the incident was presented to the fiscal as evidence for the charges filed against the two barangay officials.

Meanwhile, Quinto and Morillo said they will also file counter charges against MPS.

The conflict stemmed from the letter signed by Quinto addressed to all barangay officials of Poblacion, Department of Interior and Local Government (DILG), Liga ng mga Barangay, Land Bank of the Philippines and the Treasury and Accounting Department, that stated “Please be informed that this November 24, 2014, the proceedings in Administrative Case no. 1-2014, is terminated without determination on the merits. The preventive suspension issued against Quinto and Morillo is now moot and academic. They are deemed ipso facto back in office.”

The resolution referred to in the letter was SB Resolution no. 2014-114 entitled “Terminating the hearing and investigation in the administrative case no. 2014-01 against Punong barangay Joselito Quinto and barangay kagawad Melinda Morillo of barangay Poblacion, for grave misconduct and referring the same to the regular courts for reception of evidence.” (Hilda M.
