Theft case dismissed after 24 hours
“THIEVES-TURNED-CUSTOMERS”
BINMALEY—Three men were accused by a storeowner of stealing from her store on October 7 only to be acknowledged by the latter the following day as customers, resulting in the prompt dismissal of the complaint.
The Binmaley Police Station (BPS) received a complaint about a theft at Mc Bryan store inside the public market in Barangay Poblacion, Binmaley, around 1:30 p.m. of Oct. 7 and quickly pursued the suspects.
The police cornered the three suspects along Barangay Naguilayan national highway. Confiscated from them were assorted grocery items and vegetables.
The suspects were detained at the Binmaley police jail.
The following day the storeowner, Minda Fernandez, executed an affidavit of desistance, stating “that after a careful analysis and deep soul searching of the circumstances of the case I filed against the respondents, I realize that the matter was just a misunderstanding and misappreciation of the facts…”
With the Affidavit of Desistance executed by Fernandez and her admission that she only overreacted, and that the items which she initially thought were being stolen “when in fact they are to buy (sic) what they have taken from my grocery store.
The suspects-turned-customers were released from jail and the originally “stolen” and “bought” items, including the seized motorcycle were released to them. (Johanne R. Macob)
