Treasurer empowered to close establishments

NO PERMIT, NO BUSINESS 

IN a bid to level the playing field for the business sector, the Dagupan City government will no longer tolerate delinquent business establishments to continue operating if these cannot present current business and mayor’s permits each year.

The Sangguniang Panlungsod (SP) here made certain of this by passing an ordinance that  amended the Dagupan City revenue code specifically Article 15 titled “Mayor’s Permit”.

The new ordinance gives the city treasurer the authority to close business establishments “without or with expired, non-renewed business and mayor’s permit on or before January 20 of every year.”

Councilor Jeslito Seen, the author of the ordinance said that the amendment had to be made after residents of a barangay submitted a complaint letter to the SP against a poultry buisness was started in the barangay without clearances and the necessary permits from the city hall.

The SP soon found out that a number of establishments were opeating without permits for many years and the city government was powerless to act agasint them without an ordinance empowering the CTO to close down establishments that did not secure permits to operate in the city.

The ordinance provides for a 30-day period within which an establishemnt that receives a demand letter for operating without current business and mayor’s permits to comply. Failure to do so would lead to the immediate closure of the establishment.

“This is to ensure that all businesses in the city are operating legally”, said Seen.

Seen clarified, however, that exempted from the coverage of the ordinance are microbusinesses in barangays whose gross capital do not exceed three million pesos.  They are deemed exempted under the Barangay Microbusiness Enterprises Act of 2002.

The new ordinance will be enforced as soon as Mayor Belen T. Fernandez approves its enactment. (Hilda M. Austria)
