Dagupan seeks a more authoritative revenue code

THE mayor’s office has submitted a proposed ordinance to the Sangguniang Panlungsod (SP) seeking to add more teeth to the Revenue Code of Dagupan (Ordinance No. 1855-2005), particularly to give the city treasurer authority to close establishments that operate without a business permit or mayor’s permit .

The proposed ordinance says that the operation of illegal businesses is detrimental to the city government as it deprives the city of sources of revenue, thus limiting its capacity to secure effective and efficient delivery of public goods and services to its constituents.

Section 133, Article 15 of Ordinance No. 1855-2005 merely provides: “Imposition of Fees. The following permit fees shall be collected for the issuance of a permit by the City Mayor to operate a business, pursuant to an occupation or calling, or undertake an activity within the City.”

The proposed amendment adds the following provision in the Revenue Code: “Section 133.a. The City Treasurer is hereby granted the power to close businesses under the following circumstances:

1. Operating without Business Permit or Mayor’s Permit, and

2. Non-renewal of existing business permit or mayor’s permit on or before January 20 of every year.”

Another proposed additional provision is: “In case of operating without business permit or Mayor’s permit, closure will follow immediately after the first demand. As regards non-renewal of existing permit on the date herein specified, business owners are given five (5) days to pay from final demand. Closure will immediately follow after the lapse of five (5) days without payment of the necessary renewal fee”.
