Decorp asserts “status quo” on MC Adore bank dues

THE Dagupan Electric Corporation (Decorp) has asserted that it is constrained to continue charging the electric consumption of a private bank located at the controversial MC Adore building to the city government.

“Our assumption is, it (electric consumption of the bank) is being paid by whoever owns the account,” said Decorp Retail Service Manager Dominador Liwag Jr.

Liwag, speaking during the KBP Forum on Thursday, explained, “First, the meter is owned by Dagupan Electric. It is not owned by the city nor by the other party. The meter and the facilities are owned by Decorp. But  Dagupan Electric has an existing contract with the city government of Dagupan,” Liwag explained.

The meter and facilities at MC Adore were installed by Decorp in 2003 with the specific purpose of providing power for the renovation of MC Adore and for the power supply of the police community precinct that was housed there.

The police community precinct has transferred to the second floor of Malimgas Public Market and its former space is now occupied by the bank.

“We were not informed before that it would be used for any other purpose other than its original intentions,” Liwag said.

Liwag did acknowledge that the company is aware of the legal tussle involving the sale of the building but he stressed that Decorp was never officially informed of the transactions.

“So when we learned, we assumed that somebody else from our counter-party, the city government of Dagupan, must have allowed it…kung sino po ang aming counterpart to the contract is responsible to what happens in its side of the contract,” he explained.

“As of today, the contract between Dagupan Electric and the city of Dagupan subsists. Yon pa rin po and aming ka-kontrata. It is the city of Dagupan which has an existing contract with Dagupan Electric and nobody else,” he added.

The bank in question, City State Savings Bank approached Decorp regarding its power supply but Decorp could not provide it with a connection in the absence of a renovation permit as well as business permit from the city government.

The bank is a subsidiary of AMC ALD Holdings Inc., the company that bought MC Adore from the city government last year under the term of then Mayor Benjamin Lim for P119 million.

However, the authorization given by the Sangguniang Panlungsod to the mayor for the sale was declared null and void by the Regional Trial Court.
