Motion filed to declare MC Adore sale invalid

MORE than a week after the Regional Trial Court (RTC) declared as null and void the resolution passed by the Sangguniang Panlungsod (SP) in a controversial special session on April 20, 2012 authorizing Mayor Benjamin Lim to initiate the sale of MC Adore, a new motion has been filed seeking to officially nullify the sale of MC Adore.

The motion was filed anew before the sala of Regional Trial Court Judge Mervin Jovito Samadan by lawyer Borromeo Bustamante, counsel of the petitioner Ryan Ravanzo, secretary of the SP.

“The basis for our motion is that since the resolution authorizing Mayor Lim to initiate the sale of MC Adore was declared by the court as null and void, it follows that all subsequent acts committed by Mayor Lim, including the sale of MC Adore, are also null and void,” said Bustamante.

“Logic dictates that when the mother resolution is null and void, all the other acts committed thereafter in connection with the subject matter are also null and void,” Bustamante added.

Meanwhile, acting legal officer Roy Laforteza who defended the sale has not commented on the earlier court decision nullifying the resolution.
