Binmaley stallholders ask for conditions prior to demolition

BINMALEY—Twelve stall owners along Plaza Rizal Street here have appealed to the municipal government to hold its plan to relocate them until after it completes its plan for a new building at the site and to specify when the project will start and will be completed.

Appearing before the Sangguniang Bayan chaired by Vice Mayor Pedro Merrera Jr., the stall owners led by lawyer Armenio Escar Jr. said they have not even been informed as to what materials will be used in the temporary stalls where they will be relocated.

The planned project will be a new commercial building to be funded by a P20 million loan of the municipality from the LandBank of the Philippines.

Escat said the stallholders were bothered by reports that food chain giant Jollibee and Mercury Drug have already been allocated spaces in the new commercial building before they could even make their own reservations.

The original stall owners asserted that they must have preemptive rights to the new commercial spaces since they are in prior possession of the area.

They also questioned the plan of the municipal government to collect “goodwill money” of P250,000 to P300,000 per stallholder.

Escat said since there is no municipal resolution or ordinance providing for the collection of goodwill money and this is illegal and tantamount to illegal exaction.

At the same time, they are worried that the rental fee in the new  building is reportedly set at P3,500 per stall monthly. They are currently paying  P700 per month.

At the same time, they questioned why the stalls of Dr. Cecilio Terrado, the municipal administrator, would be spared from the demolition.

The stallholders said that they are not opposing the project of the municipality as long as their legal rights are respected and observed.
