Mata: 2 beach “resorts” in Binloc are illegal
AT LEAST two beach resorts that have set up shop at the Bliss-Silungan area in Barangay Bonuan Binloc were finally confirmed to be illegal by City Administrator Vladimir Mata.
Tres Gracias and Dimla’s Resort, according to Mata, were built on public land, constructed and operating without the necessary permits, and, therefore, subject to demolition.
At the same time, Mata reiterated that the City Mayor’s Office did not issue any waiver or permit to the owners of these establishments for their electricity service connection. (See related story on page 1)
In his 24 November letter to the Sangguniang Panlungsod (SP), Mata said the Zoning Division of the City Planning and Development Office (CPDO) did not issue locational clearances to the owners the two resorts.
Architect Emmanuel Palaganas, planning officer of the CPDO, said per Zoning Ordinance 957-78 and 1840-05, the area occupied by Tres Gracias is zoned as residential (Bliss Site), park and open space, and beach area.
The Bliss Site is separated by a three-meter road from the Silungan Area.
“Building structures of any kind in this zone are absolutely prohibited. Except for bank or zone stabilization structures, fences to set off the easement from private property lines or footpaths and walkways in case such easement are developed into public parks, promenade and the like”, Palaganas said.
Mata also said the City Engineer’s Office has already issued on Nov. 9 a Notice of Removal/Demolition to the two resorts.
Meanwhile, City Engineer Virginia Rosario, in a separate letter to the vice mayor dated November 14, 2011, identified the owners of the Tres Gracias as couple Jose V. Cruz and Jacinta P. Cruz while Dimla’s is owned by Roberto Dimla and Loida Dimla.
Rosario echoed Mata’s message saying both resorts, located on a public land, are operating without the necessary permits, and that her office already issued the First Notice to the resort owners advising them to remove/demolish their building/structure last Nov. 9, 2011.
Further, Rosario reported that there are other structures in the area used as residential, rest houses and cottages.
KAPITAN’S RESPONSIBLITY
Rosario said that in order to stop the proliferation of squatters or informal settlers, the Punong Barangay should prevent the construction of any kind of illegal dwelling units or structures within their area of jurisdiction.
She cited Sec. 391 (a) (18), Chapter IV of the Local Government Code (Republic Act 7160) that mandates the Sangguniang Barangay “to adopt measures to prevent and control the proliferation of squatters and mendicants in their Barangay”.
The SP is undertaking an inquiry on the resorts operating in the foreshore land of Bonuan Binloc following reports by residents during the council’s outside session at the Federico Ceralde Integrated School in Bonuan Binloc last Nov. 8.
