13th month pay is mandatory – DOLE

THE Department of Labor and Employment (DOLE) said all employees are entitled to 13th month pay under the law regardless of status or the method by which their wages are paid.

Emmanuel Hagad, head of DOLE Pangasinan provincial field office, made the clarification in a radio interview last week as he reminded all employers to comply with the law.

Hagad said many employees are unaware of this law and are deprived of the benefit.

He encouraged employees to file a complaint with the nearest labor office in their area should their employers fail to give them their due.

Payment of the 13th month pay is retroactive, which means that a complainant may be able to claim the unpaid amount but limited only to the last three years, he added.

Hagad also pointed out that the 13th Month Pay must not be considered a “Christmas bonus”, something that the employer may give according to his discretion.

DOLE Region 1 earlier issued a memorandum ordering all private employers to give the 13th Month Pay before Christmas Day.

However, only workers employed at his or her workplace for at least one month can receive the pay. (PIA-Pangasinan)
