New prosecutor named in Resuello slay case
FILING OF CHARGES STILL PENDING
JUSTICE so near yet so far.
This was the sentiment of the family of the slain Mayor Julian Resuello on learning that the filing of charges against 16 persons accused for the murder was suspended anew.
Reason: a motion for reconsideration was filed and a subsequent motion that sought to inhibit the prosecutor who penned the resolution from acting on the motion for reconsideration by one of the accused were acted on favorably by the prosecutor’s office.
Prosecutor Paulyn Aquino, who recommended the filing of charges against the respondents, found herself out of the case and a new prosecutor has been named to evaluate a motion for reconsideration of Aquino’s resolution.
Provincial Prosecutor Gonzalo Marata of Dagupan City has been designated to act on the motion for reconsideration filed by Mendoza.
The case was already transferred twice with Aquino being the last and reversed the earlier resolution acquitting all those charged.
Those earlier recommended to be charged were former Mayor Douglas Soriano, Loida Mendoza, Atty. Monte Ignacio Sr., Sammy Mendoza, Jay-Ar Maiquez, Rudy Melano, Montesson Ignacio Jr, Joel Ginez, Pablito Viernes, John Tumabcao, Rodolfo dela Cruz, Rommel dela Pena, Sonny Echalas, Rowena Viernes Mendoza, Reynaldo Mendoza and Ka Nora.
San Carlos Mayor Julier Resuello, son of the slain mayor, lamented that the latest legal maneuver by the accused, which he believed, was made possible by the unexplained unusual 36-day delay in the delivery of Aquino’s resolution to his family.
Aquino’s resolution was dated July 27, 2009 but it was only on September 2, and only after when the Resuellos demanded a copy from the Prosecutor’s Office, when they finally received a copy. The young Resuello said the family only learned of Aquino’s resolution belatedly from another source.
“Imbes na yong nagrereklamo ang binibigyan ng kopya, bakit na delay yata ang pagbibigay sa amin,” said Resuello during last week’s “Engkwentro” breakfast forum at Lenox Hotel.
The camp of the accused, on the other hand, reportedly received a copy earlier enabling Mendoza to file a motion for reconsideration on August 18.
This was reportedly followed by Soriano’s motion seeking to inhibit Aquino from acting on Mendoza’s motion for reconsideration after granting it.
A statement from any of the accused was sought by the PUNCH but proved futile. —LM
