Murder charges filed vs. ex-mayor, 15 others

SAN CARLOS CITY–Reversing a previous resolution, the acting city prosecutor here has re-commended the filing of double murder and multiple frustrated murder against a former mayor and 15 others for the killing of Mayor Julian Resuello and his bodyguard two years ago.
In a 14-page resolution dated July 27, 2009, a copy of which was obtained by the Resuello family on Wednesday last week, Prosecutor Paulyn Maurie dela Cruz Aquino granted the motion for reconsideration to file charges against former Mayor Douglas Soriano and 15 alleged accomplices.
Assistant City Prosecutor Reynaldo Lacasandile, in an earlier resolution dated February 26, 2009, recommended the dismissal of the charges for lack of probable cause.
Aquino recommended the filing of criminal information for double murder and multiple frustrated murder against Soriano, Loida Mendoza, Atty. Monte Ignacio Sr., Sammy Mendoza, Jay-Ar Maiquez, Rudy Melano, Montesson Ignacio Jr, Joel Ginez, Pablito Viernes, John Tumabcao, Rodolfo dela Cruz, Rommel dela Pena, Sonny Echalas, Rowena Viernes Mendoza, Reynaldo Mendoza and Ka Nora.
“Based upon the evidence submitted on record, the undersigned is of the humble opinion that there exists probable cause to believe that all of the herein respondents conspired with each other and acted in concert with Angelito Mamaril and Cesar Cabesa de Guzman to commit the crimes complained of,” Aquino said.
Mayor Julier Resuello, son of the murdered mayor, said he is elated about the recommendation, but at the same time expressed dismay over the Office of the Prosecutor’s failure to immediately provide them a copy of the resolution.
He said the family got a copy on their own initiative only after being tipped by a “very reliable source”.
“We have not been provided a copy even after one of the accused already filed a motion for judicial determination of probable cause,” he said.
Loida Mendoza already filed on August 24 a motion for judicial determination of probable cause with a prayer to quash any warrant of arrest prior to the hearing of her plea.
Resuello was gunned down during a town fiesta event in April 28, 2007, which was also a campaign period for the elections in May that year wherein Resuello, after having served the maximum term of office, was running as vice mayor.
His aide, Eulogio “Jojo” Martinez, also died in the ensuing shootout that left others wounded, including civilians and one of the alleged hitmen. #
