TAYUG– Former mayor Madelyn Cabotaje-Ramirez has won a Regional Trial Court battle declaring her as the winning vice-mayoralty candidate in last year’s election.

However, the lawyers of sitting Vice Mayor Janette Zaragoza said they are preparing to appeal the decision before the Court of Appeals to prevent Ramirez from taking over the post.

The decision was penned by Judge Emma Parajas of Branch 32 based on the election protest filed at her sala by Ramirez over the result of the vice mayoralty election in May 2007.

“After deducting 122 votes in the original 8,158 protester’s votes, she has a total of 8,036 votes while protestant (Ramirez) has 8,118 votes after adding seven votes to her original votes of 8,111,” the decision reads in part.

This means that at the end of the vote recount, Ramirez won over Zaragoza by 82 votes.

In the original final count of the Municipal Board of Canvassers, Ramirez, then incumbent mayor, lost to Zaragoza by only 47 votes.

Zaragoza filed a counter-protest against Ramirez in the same court but Paragas still favored Ramirez when the latter was found to have beaten Zaragoza in her own bailiwick Barangay “D” and Carriedo.

Ramirez’s supporters celebrated the court victory by putting up banners around town announcing early Christmas greetings.- LM
