Dagupan gets clean land titles of old MC Adore Hotel

THE city government finally obtained clean titles for the lots occupied by the former MC Adore Hotel following a decision by the Regional Trial Court that became final and executory on March 17 this year.

RTC Judge Robert Rudio on February 6, 2007 ordered the Register of Deeds to cause the cancellation of the adverse claim over the properties occupied by MC Adore covered by Transfer of Certificates of Titles Nos. 85543, 85544, 85545 and 85546, upon payment of the prescribed fees.

The petition for the cancellation on adverse claim was filed on November 17, 2007 by the City Government of Dagupan, represented by Mayor Alipio Fernandez Jr.

Copies of the petition were posted in bulletin boards of the Register of Deeds, Sangguniang

Panlungsod, City Prosecution Office and Office of the Barangay Captain of Barangay IV, but no one appeared to make any opposition to the claim.

The adverse claim on the property dated January 14, 1981 was filed by Archbishop Federico Limon, now deceased, which was annotated and inscribed on July 24, 1981 under Entry No. 100961/F-31107 in the Register of Deeds and carried over in Transfer Certificates of Title Nos. 85543, 85544, 85545 and 85546.

The annotation meant that Archbishop Limon was claiming rights and interests in the said titles.

However, in deciding in favor of the petitioner, Judge Rudio cited Presidential Decree No. 1529, otherwise known as Property Registration Decree, which provides in part, “The adverse claim shall be effective for a period of thirty days from the date of registration. After the lapse of said period, the annotation of adverse claim may be cancelled upon filing of a verified petition thereof by the party in interest.”

The MC Adore property was bought by the city government for P50 million from the Privatization Management Office.—LM
