City hall scores victory in drive to clear all sidewalks
Finally, illegal structures will be removed.
The city government scored a major victory in its effort to clear all sidewalks of illegal structures following an amicable settlement agreed upon by property owners and the city government before the court on Thursday.
The agreement stemmed from a civil action for injunction and petition for the issuance of a Temporary Restraining Order filed by at least seven property owners of Burgos street against the Dagupan City Engineer’s Office represented by City Engineer Virginia Rosario.
The case was filed before the sala of Regional Trial Court Judge Roberto Rudio by Tito Samson, Adson Chua, Roque de Castro, Rezah De Castro Robina, Rhoda Charina De Castro, Rinah De Castro and Roehl de Castro, who also served as the group’s legal counsel.
Judge Rudio called the plaintiffs and the defendant, including their respective counsels, to his chamber on Thursday where they agreed to amicably settle the case among themselves.
The City Engineer’s Office was represented by City Legal Officer George Mejia.
In the court-moderated settlement, the plaintiffs were given another 20 days from Thursday to demolish or remove their perimeter walls and other structures that encroach on the sidewalks at their own expense.
After 20 days, the City Engineer’s Office will demolish any illegal structure left untouched at the expense of the city.
“This is definitely a victory for the city because instead of going to court which could take long, we have come to a compromise where everybody is happy,” Mejia said.
“The plaintiffs are happy because they were given up to 20 days to remove their structures while the city is happy because finally the sidewalks will be eventually cleared of illegal structures,” Mejia said.—LM.
