Lim lawyer mulls impeach rap versus Commissioners

The lawyer in the disqualification case against House Speaker Jose De Venecia has cried foul and is accusing the Commission on Election of a biased decision.

Lawyer Francisco Baraan III said he will formally file an impeachment case against Comelec Chairman Benjamin Abalos and the Comelec commissioners who signed the resolution in favor of De Venecia.

The commissioners are Resurreccion Borra, Florentino Tuason, Jr., Romeo Brawner, Rene Sarmiento and Nicodemo Ferrer.

Baraan, the chief legal counsel of Dagupan City Mayor Benjamin Lim, said the Comelec’s decision was passed one day before the Comelec office in Dagupan was scheduled to hold the first hearing on the case.

Lim and De Venecia are fighting it out for the fourth district congressional seat.

“We are out to prove that the insurance cards were given indiscriminately. One of my witnesses is a 68-year old retiree who under normal circumstances is no longer qualified to be covered by insurance,” Baraan said in a press briefing.

He added, “All of them know that there is a pending case in Dagupan City against JDV. It is impossible for them not to know it because it is all over the newspapers. But for them to issue a resolution on a one-sided opinion despite their knowledge of existence of a pending case in Dagupan is an instance of impartiality and violation of due process.”

Baraan said that such action by the commissioners is a very good basis for impeachment.
