SC throws out case vs. Judge Butuyan

TAYUG—The Supreme Court (SC) has dismissed the administrative complaint filed against Regional Trial Court Judge Ulysses Raciles Butuyan by the widower of the late Pasay City Judge Estrelita Paas who was murdered in their home in Natividad in 2005.

This was contained in a communication dated January 24, 2006 from Enriquta Esguerra Vidal, clerk of court of the SC’s 1st division and co-signed by Edgar Aricheta, assistant clerk of court.

The complaint against Butuyan was filed by Renerio Paas, husband of the late Judge Paas, through his counsel, as an aftermath of the dismissal by Butuyan of cases filed against the suspects Jornald Vargas and Elmer Cabiles.

In that complaint, Butuyan was charged with violation of the anti-graft and corrupt practices act, the code of judicial conduct (impartiality and impropriety) and the revised penal code, gross ignorance and gross incompetence.

However, the 1st division of the Supreme Court dismissed the complaint for raising judicial matter and for lack of merit.

At the same time, the SC 1st division noted the report of the Court Administrator on the matter dated 26 October 2006.
