Cancel all certificates, vice mayor dares DENR

THE Department of Environment and Natural Resources (DENR) has been dared to cancel or withdraw all the certificates it issued to numerous persons and entities attesting that certain portions of land near the Lingayen Gulf in Dagupan are alienable and disposable.

In a recent letter, Dagupan vice mayor and city council presiding officer Alvin

Fernandez to the DENR, he noted that the government agency cancelled only 34 or 38 Certificates of Alienability and Disposability (CAD) that were unlawfully issued by its unscrupulous field personnel for a still undetermined amount of fees.

The CADs were used by individuals and entities in securing Tax Declaration Certificates (TDC) from the City Assessor’s Office.

Noting that the number of CAD cancelled or withdrawn by the DENR was far less than the number of TDCs issued by the City Assessor’s Office, Fernandez asked the agency to cancel all certificates that were issued to finally bring to a close the issue of massive land grabbing of the beach land in Dagupan.

Fernandez said based on a recent letter sent to him by Provincial Environment and Natural Resources Officer officer-in-charge Rogel Pimentel, there were 34 to 38 CADs that his office had so far cancelled.

But he noted that the number of CAD cancelled did not correspond to the number of TDCs issued by the Assessor’s Office, totalling 94 or 98. (Documenrts handed to THE PUNCH showed, there were actually 152 TDCs that were issued, although less than 50 are still subject for verification.)

NOT FOR BEACH HOUSES

Fernandez said it appears that all the claimants of the accreted area near the Lingayen Gulf want to convert the lands that they are claming as locations for their rest and vacation houses.

But based on existing guidelines for alienable and disposable lands, the same must be used exclusively for agricultural or orchard purposes and not as location for beach resorts.

However, the move, Fernandez said, will not necessarily do away with the problem of squatting, not only in the accreted land but also within Tondaligan Park.

Documents obtained by THE PUNCH showed that 20 to 30 hectares of the proclaimed park in sitios Magkaisa, Maligaya and Bagong Baryo in Bonuan Gueset were already occupied by informal settlers.

Also occupied were about 10 to15 hectares of the proclaimed park in sitio Silongan, the Muslim area and the dump site in Bonuan Boquig, and from 20 to 30 hectares of the proclaimed park and accretion area in sitios Japan, Russia and Baybay in Bonuan Binloc.

These documents are proof that the column items of lawyer Gonzalo Duque in The PUNCH regarding the massive land grabbing in the Tondaligan Park had basis indeed.

STOP LAND SPECULATION

Cancellation by DENR of all the CADs it issued may eventually stop massive land speculation activities along the Dagupan shore and fortify the applications for Miscellaneous Lease Agreement filed with DENR by the Dagupan City government now pending at the office of Environment Secretary Angelo Reyes.

Fernandez maintained that the accreted land, formed throughout the years by sand and sediment being washed ashore from the Lingayen Gulf, is part of the public domain and therefore inalienable and disposable.

Furthermore, the Supreme Court in a landmark decision-ruled that parks and plazas are beyond the commerce of man.

Fernandez warned holders of TDCs that what’s in their possession are mere proofs of claims but not proofs of ownership of properties, adding that ownership can be had only through a Miscellaneous Lease Agreement with the DENR, which is now being pursued by the Dagupan City government.

The vice mayor wondered how come the DENR attested that some of these lands are alienable and disposable when in fact they are not in the absence of any Presidential Proclamation or an act of Congress.
