Terminated insurance workers paid finally

“We are happy with the decision”.

Thus said Baltazar Mendoza, former manager of the Philippine Phoenix Surety and Insurance, Inc. (PPSI), after he and three other former employees signed quit claim/release documents that finally wrote finish to their dispute with their former employer.

All four complained against the insurance company before the National Labor Relations Commission branch in Dagupan City.

Mendoza said they respected the decision of the labor arbiter although she found them not illegally dismissed but terminated from employment for just cause.

A decision on Aug. 1, 2005 of Niña Fe Lazaga-Rafols, labor arbiter, ordered PPII to pay Mendoza and his wife, Tessie, of their proportionate 13th month pay and the commutation of their vacation leave pay for 2004.

Also paid their longevity pay for the prescribed period of three years back reckoned from their last day of employment were Juvy Rico and Fernando de Vera.

All former employees of PPII complained before the NLRC of illegal dismissal, and sought claims for retirement pay, and quarterly attendance incentive and food allowance benefits. However, these were dismissed by NLRC for lack of evidence.

The labor arbiter also said the four complainants can not qualify and be entitled to early retirement that they were seeking.
