DOLE issues pay guidelines for August holidays
THE Department of Labor and Employment (DOLE) has released official guidelines on pay rules for two upcoming holidays in August 2025.
Under Proclamation No. 727, signed by President Ferdinand Marcos Jr., August 21 is declared a special non-working holiday in commemoration of the 42nd anniversary of the assassination of Senator Benigno “Ninoy” Aquino Jr, while August 25 is a regular holiday in observance of National Heroes Day.
In line with the classification of these holidays, DOLE clarified the applicable payment rules for employers and employees:
- For Special Non-Working Holiday (August 21), no work, no pay applies if the employee does not report to work, unless a company policy, practice, or collective bargaining agreement provides otherwise;
- Employees who report for work must be paid an additional 30% of their basic daily wage for the first 8 hours;
- Work rendered beyond 8 hours will be compensated with an additional 30% of the employee’s hourly rate;
- If the special non-working holiday falls on the employee’s rest day, those who report to work are entitled to an additional 50% of their basic wage for the first 8 hours; and
- Overtime work on a rest day and special holiday entitles the employee to an additional 30% of their hourly rate on top of the 150%.
Meanwhile, for National Heroes’ Day, which is a regular holiday, employees who do not work on this day are still entitled to receive 100% of their daily wage, provided they were present or on official leave of absence with pay on the workday immediately preceding the holiday.
Employees who work on a regular holiday are entitled to 200% of their basic wage for the first 8 hours. For work in excess of 8 hours, employees must be paid an additional 30% of their hourly rate.
If the regular holiday falls on the employee’s rest day, those reporting for duty are entitled to an additional 30% of their 200% wage.
