City hall still awaiting Cuna’s reply

FINAL DEMAND FOR P16-M

THE Dagupan City Legal Office is still awaiting the reply of Jose Mariano Cuña to the final demand letter sent to the latter onNovember 26 for the return of P16.1 million, including a 12 percent per annum, that he received as payment for the undelivered 30-hectare land he sold to the city in 2002.

Mayor Belen Fernandez, in a text message, to The PUNCH, confirmed that Cuña has not replied to the demand letter.

“We are waiting for the reply,” the mayor texted.

She said the city government will file a case in court if Cuña continues to ignore the demand letter, as she pointed out that it was the Commission on Audit Observation Memorandum that compelled the city government to send the demand letters to Cuña.

Cuña responded to the City Legal Office’s first demand letter sent on November 5with merely a question, asking for copy of the final decision of theDepartment of Agrarian Reform Adjudication Board that  declared as null and void the sale of the  30-hectare land to Cuna of the in 2001 for P7million and the subsequent sale of the land by Cuña to the Dagupan City government for P16 million.   

She earlier told the KBP Forum last week that the amount, including its interest will be appropriated to help fund the construction of a three-storey school building.

When Mayor Fernandez took over the city government in 2013, she found that despite the payment of P16.1 million to Cuña, no land title was delivered to the Dagupan City government. (LeonardoMicua).
