Ex-Binmaley mayor faces graft charge

FOR ANOMALOUS LEASE CONTRACT

ANOTHER former town mayor has been charged by the Ombudsman.

The finding of probable cause against Lorenzo Cerezo, former Mayor of Binmaley, was affirmed for 21 counts of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019).

No. 3019 states that public officials are prohibited from causing any undue injury to any party, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence.

Also charged with Cerezo is Edwin Castillo of MTAC Merchandising (MTAC). The case stemmed from the alleged anomalous lease contracts of construction equipment.

In its resolution, the Ombudsman found that from November 2011 to April 2013, Cerezo approved 21 contracts worth P2 million covering the lease of dump trucks, back hoes, pay loaders and cement mixers from MTAC without any public bidding.

“Without public bidding, the government was deprived of the best possible price for the lease of heavy construction equipment,” the resolution underscored. (PIO, Ombudsman)
