WHO says that the case filed against city officials led by Mayor Benjamin Lim on the sale of the MC Adore property is over and that the subsequent bidding and selling is legal and binding?

Proving that nothing is over, Torio held a hearing last week on the motion of the respondents for the nullification of the preliminary injunction.

During the hearing, Torio granted the request of Bustamante requested that he be given 15 days to study and submit his position vis-à-vis the respondents’ motion to nullify the preliminary injunction issued by the court.

Bustamante said he was not given a copy of the motion of the respondents and only attended the hearing upon the verbal advise of his client.

However, when the court asked Bustamante about the P50 million injunctive bond petitioner Ravanzo was asked to post, he replied that his client will attend to it as soon as he arrives in Dagupan.

Last week, Ravanzo on his own wrote a letter to the court seeking, among others, the annotation of the title of MC Adore.

The court, however, did not take cognizance of the letter since it was not submitted as a motion.

According to Bustamante, the motion will be submitted next week.

CONTEMPT

Bustamante said that he will file his client’s motion seeking to ask the court to declare Lim and members of the disposal committee for contempt, specifically for proceeding with the bidding and selling of MC Adore despite the fact that the hearing for preliminary injunction issued by the court has not been terminated.

A city hall press release identified the winning bidder as AMB ALC Holding and Management Corporation based in Makati City, represented by its finance officer Benjamin Ramos, which supposedly submitted the highest bid at P119 million.

Respondents Lim and Councilors Jesus Canto, Karlos Reyna, Librada Reyna, Alvin Coquia, Luis Samson Jr. Guillermo Vallejos, Chester Gonzales, Brian Lim and Redford Erfe Mejia were not around during the hearing.

Petitioner Ryan Ravanzo, secretary of the Sangguniang Panlungsod, was likewise not around for a personal trip in line with his role as national president of the Philippine Jaycees.

Only the lawyers of both parties were present: Borromeo Bustamante for Ravanzo and Assistant City Legal Officer Roy Laforteza for Lim and company.
