Court subpoenas Lim, 9 city dads

MC ADORE CIVIL CASE

DAGUPAN Mayor Benjamin S. Lim may have to hold off any further move in connection with the sale of the MC Adore property now that he and his co-respondents have been subpoenaed by the court in connection with the Special Civil Case on the matter filed by Sangguniang Panlungsod Secretary Ryan Ravanzo .

The subpoena order was issued Sept. 19, 2012 by Regional Trial Court Judge Emma Torio, acting presiding judge of Branch 40 in Dagupan City, to all the respondents in Special Civil Action No. 2012-0010-D.

Judge Torio set the hearing on the application for the issuance of a Temporary Restraining Order and/or Preliminary Injunction to the petition on Oct. 5, 2012 at 8:30 a.m.

Aside from Lim, the other respondents are City Councilors Jesus Canto, Ma. Librada Manaois- Reyna, Karlos Liberato Reyna, Marc Brian Lim, Redford Christian Mejia, Luis Samson Jr., Alvin Coquia, Guillermo Vallejos and John Chester Gonzales

All respondents have been ordered by Torio “to submit within 10 days from receipt of the order their comment to the petition, copy furnished the petitioner (Ravanzo) through his counsel Atty. Borromeo Bustamante.”

All the respondents were served with copies of the order and petition by the Sheriff of the Court.

DISPOSAL COMMITTEE

The order means that the city government cannot proceed further in bidding out MC Adore to interested buyers.

Lim, however, is reportedly preparing to name the members of the disposal committee that will handle the sale of MC Adore as he maintains that there is nothing irregular in the resolution passed by nine members of the Sangguniang Panlungsod during a special session called by Lim on April 20, 2012.

The resolution authorizes Lim to initiate the sale of MC Adore as well as the property owned by the city in Barangay Talibaew, Calasiao.

“My office will move on to sell the properties upon the creation of the disposal committee,” Lim told newsmen at city hall last week before the subpoena was served.

The mayor earlier brushed aside the case filed by Ravanzo saying it will unlikely prosper as Ravanzo himself was well aware of the resolution and had in fact witnessed the approval of the minutes of the same in a regular session of the SP.

Lim has formed an appraisal committee which already put the property’s value, both building and the lots, at a minimum of P100 million.

The appraised value has been submitted to the Commission on Audit regional office for evaluation.

The respondent councilors are reportedly planning to pass a resolution declaring loss of confidence in the SP secretary, but Ravanzo said he is unfazed by the reported move.
