Dagupan SP’s ordinance naming creek rejected
THE Sangguniang Panlalawigan of Dagupan was recently taught a lesson on when it can and cannot pass an ordinance naming sites by the the National Historical Commission of the Philippines (NHCP).
In its 2nd endorsement dated 7 August 2020 but was only received November 20, 2020, Ordinance No. 2209-2020 entitled “An ordinance formally recognizing and naming the creek that traverses the former land property of the late couple Manuela and Ating Quinto in Barangay Lucao as “Manting Creek” was thrown out the window.
The letter signed by Dr. Rene R. Escalante, chairman of NHCP, addressed to City Secretary Ryan Ravanzon and copy furnished Mayor Marc Brian Lim was in response to a letter sent by the SP to NHCP enclosing the enacted Ordinance No. 2208-2020.
In his 2nd endorsement, Dr, Escalante cited Section 13 of the Local Government Code of 1991 or Republic Act 7160 only provides Local Government Units the authority to name or rename barangays within their territorial jurisdiction, roads, avenues, boulevards, public hospitalps, clinics and other health care facilities and public infrastructures owned by the LGU in question.
Natural landforms and bodies of water such as creeks are not included among those which may be named or renamed.
The same, he said, is reiterated in Guidelines III-10 of NHCP’s Revised Guidelines: Natural features such as islands, rivers, seas, oceans, mountains and plains shall not be renamed, unless these are being reverted to their old indigenous names”.
