Mangaldan cops charged before Ombudsman
MANGALDAN— It was payback time for the town’s chief of police and nine other policemen after the prosecutor’s office dismissed the case they filed) against punong barangay Joselito Quinto and councilwoman Melinda Morillo of barangay Poblacion here.
The two barangay officials filed countercharges before the Ombudsman.
Atty. Joseph Manuel Cera, lawyer for Quinto and Morillo, confirmed his clients’ complaints against P/Supt. Jackie Candelario chief of MPS, SPO1 Rolando Mercado, P/SI Hermy Dumucmat Ancheta, PO2 Ulysses Serandon, PO2 Noel Ulanday, PO2 Benjamin Solis, PO2 Richard Tibigar, PO1 Allan Rey Sagun, PO1 Marlon Angan Angan and PO1 Gary Maguliano.
In the verified complaint affidavit submitted to the Office of the Ombudsman via registered mail, Candelario and the nine policemen were charged with oppression, perjury, unlawful arrest, unlawful detention, grave abuse of authority and grave misconduct, countercharges which emanated from the arrest of the two barangay officials while inside the barangay hall of Poblacion last December 3.
The complainants asserted that even after the administrative complaint against them was terminated by the Sangguniang Bayan, “P/Supt. Candelario… did not believe us and arrogantly arrested us”.
A medico legal was also attached to the complaint to indicate the use of force against Quinto.
Cera said the policemen also failed to read the Miranda Doctrine to the two officials before arresting them and his clients were illegally detained from December 3 (11:30am) to December 4 (8:00pm).
Ancheta, the desk officer on duty at the time the incident happened, allegedly did not conduct an investigation on the incident prior to the preparation and endorsement of the charges of usurpation of authority, resist of arrest and assault to person in authority filed before the Office of the City Prosecutor in Dagupan City.
Quinto and Morillo, Cera said, also plan to file charges against Mayor Bonafe Parayno who said the preventive suspension is still in effect and the two barangay officials will still be prohibited from resuming to their posts.
Candelario, on the other hand, in reaction to the filing of complaint against him and his men said, “ That is their right if they believe we have not acted as the law requires but we also uphold that we performed our duty as mandated by the law.”
He added he will file a motion for reconsideration on the charges against the two barangay officials and motion to inhibit before the city prosecutor. (Hilda Austria)
