Dagupan ready to take Decorp to court

DAGUPAN Mayor Belen Fernandez warned that the Dagupan Electric Corporation (Decorp) risks facing a possible suit from the city government if it ignores her letter dated December 27, 2013 ordering the company to terminate their contract for the controversial electric meter located in the premises of the former MC Adore Adore Internationale Palace.

She did not, however, give a timetable on when the city government will file charges saying the matter will be handled by City Legal Officer George Mejia and City Administrator Farah Decano, who is also a lawyer and former president of the Integrated Bar of the Philippines-Pangasinan chapter.

The electric meter, contracted under the name of the city government, is being used without the latter’s permission by the CityState Savings Bank, a subsidiary of the AMB ALC Holdings & Management Corp. the company that bought MC Adore from the city government during the administration of then Mayor Benjamin Lim for P119 million.

Fernandez said as far as the city is concerned, the meter issue was resolved when she issued the letter to Decorp directing the termination of the service contract for the electric meter at the MC Adore building.

City hall observers noted that Decorp is setting a bad precedent for allowing the continued use of an electric meter by a business establishment that is not covered by any contract with the power company.

The mayor asserted that it is the city government’s prerogative as the customer to terminate the contract any time. “The city is the customer, not the bank,” she intoned.

When The PUNCH asked Decorp’s lawyer Atty. Randy Caspilian in a text last Friday as to when Decorp expects to comply with the city hall’s order, there was no reply.

Decorp’s manager Dominador Liwag also did not respond to a text message of The PUNCH last January 10 when he was asked for his reaction to the mayor’s decision not to grant his request for a meeting on her order to terminate the contract.   (LVM)
