BTF stops auctions of road lots in city

ROAD lots are beyond the commerce of man and therefore cannot be sold to any private person or even entity.
This was the opinion given by Rufino Moreno Jr. of the Register of Deeds when sought by Mayor Belen Fernandez who wants the policy of the City Treasurer since 2007 auctioning road lots in Dagupan City stopped.
“Road lots are beyond the commerce of man and if ever if it is auctioned, it goes to the city government,” Moreno opined.
The auction policy came to light during the televised excutive meeting of the mayor last Monday.
City Treasurer Romelita Alcantara earlier explained that they were auctioning road lots — even if there are no bidders — just for the the purpose of taking over these lots.
Moreno concurred with Alcantara’s explanation, “I believe that was the purpose of the city government in auctioning these properties — in order to acquire ownership of these properties.”
However, Moreno stressed that once acquired by the city, the road lot can not be formed as an asset of the city government as these are by law for public use.
Given that the practice has been going on for years, Moreno urged the mayor to order an investigation to determine the status of all real properties in the city.
Fernandez said the auction of road lots could lead to family feuds and even court cases, citing one case in Bonuan Binloc last year.
