AMB ALC Holdings, no standing in court – Ravanzo lawyer

“THEY are buyers in bad faith.”

This was the response of lawyer Borromeo Bustamante, counsel of Sangguniang Panlungsod Secretary Ryan Ravanzo, on the petition to intervene filed by the buyers of the MC Adore Hotel in Dagupan City on the case questioning the authority given to outgoing Mayor Benjamin Lim to negotiate the sale.

Bustamante, who immediately filed a reply in court on the petition for intervention last Friday, said in a telephone interview that the company has “no standing in court because if ever they bought the property, they are buyers in bad faith”.

“The action is a declaratory relief whose purpose is to declare or not the resolution authorizing Lim to sell MC Adore and the Calasiao property as valid or not,” he pointed out.

He noted that they were able to secure a temporary restraining order (TRO), after Lim advertised that they would sell MC Adore on Dec. 17, 2012, from Judge Emma Torio who was then handling the case.

A hearing on injunction was held on January 3, 2013 wherein Bustamante said they submitted their evidence.

“The life of the TRO also ended on Jan. 3, 2013 so on January 7, 2013, they sold MC Adore Hotel defying the authority of the court trying the case,” Bustamante said.

“It’s very clear they (AMB ALC) are out of this picture,” Bustamante asserted.

Ravanzo filed the case against the city government seeking annulment of Resolution 6738-2012 that authorized Lim to initiate the sale of the property.

Mayor-elect Belen Fernandez has been firm in her stand that the sale was grossly disadvantageous to the city given the sale price, which is way below the current market price.

The five-storey MC Adore property with a helipad, built in the 1970s, has a total land area of 5,113.99 square meters.

The city government, under a previous term of Lim, bought the property from the Asset Privatization Trust, which took over the property from the Development Bank of the Philippines.

It was supposedly intended as the site of a new city hall.—Eva Visperas
