Duque proposes win-win solution for ‘retake’ exams

A mere retake of the nurses’ exam will not resolve the issue.

This is the contention of Dr. Gonzalo Duque, president of Lyceum-Northwestern University, who instead suggested a “win-win” solution.

Duque, a lawyer, said while he welcomes the decision of President Gloria Macapagal Arroyo for all examinees to retake, he views the matter as dangerous and replete with a lot of legal complications.

He cited the “fact that the PRC (Professional Regulation Commission) already decided to release the result and some of the passers already took their oath and issued with their respective licenses” and pointed out that “there is no point punishing the students for the illegal acts committed by one or two members of the nursing board who may have leaked the questions”.

Instead, he advised all concerned to first await the decision of the Court of Appeals on the case pending before it that led earlier to the issuance of a temporary restraining order. He said the Court of Appeals belongs to a separate branch of government from that of the Office of the President.

In order to avoid costly legal battles, he suggested that those who failed in the examination and allowed to retake the test and should be considered as first timers and not repeaters.

He added that those who already passed the examination should be allowed to go on with their own lives by allowing them to take their oath and be issued their respective licenses.

Although a close ally of President Arroyo, Duque expressed the view that the decision asking the passers to retake the test is to preempt the case pending before the CA.

Duque foresees more legal problems to come if the passers assert their rights under the law.

He added that requiring the passers to do a retake is “unFilipino” since the parents of the successful examinees have already celebrated and really spent for it.

“This is quite embarrassing if you undo everything that was already done,” he said

Duque said his “win-win” solution is a good compromise, ensuring a happy resolution for all.
