Ex-mpl. engineer files rap vs. Anda mayor
ANDA—A complaint was filed before the Ombudsman against Anda Mayor Aldrin Celdran for possible violation of Republic Act 3019, the Anti-Graft and Corrupt Practices Act, specifically for malversation of funds and falsification.
The complaint, filed by Anastacio C. Cale, a recently retired municipal engineer of the town, alleges that the mayor allowed the use of various equipment and personnel of the municipality by a private contractor for an irrigation project supposedly funded under a national government agency.
Cale cited the use of backhoe, payloader and two units of municipal dump truck, provision of fuel as well as the use of drivers and operators of the municipality between Feb, 7, 2012 to April 30, 2012 for the construction of a project of the National Irrigation Administration (NIA) in the town.
The project was the Sablig Communal Irrigation System (CIS), which is not under the municipal government.
Cale said there is no provision in the contract between the NIA and the private contractor, the JASA Builders of Bolinao, for the utilization and deployment of municipal equipment in the construction of the Sablig CIS and that the mayor had no authority from the Sangguniang Bayan (SB) to provide such.
Among the evidence cited by Cale in his complaint was an affidavit of town councilor Ester Carpo stating that there was never any resolution passed by the SB authorizing the use of equipment, funds, fuel and personnel of the municipality for the NIA irrigation project; copy of the contracts between the NIA and JASA Builders of Bolinao, photocopy of a picture showing the use and deployment during an ocular inspection by Cale and others.
Cale further accused that Cerdan actually “sub-contracted” the project of the NIA from the private contractor and then used municipal resources.
OTHER COMPLAINTS
In a second complaint filed by Cale before the Ombudsman, he accused Cerdan of violation of Section 3 (e) of RA 3019/Malversation/Falsification for allegedly signing several disbursement vouchers in various amounts between P4,500 and P5,000 in favor of “fictitious indigents”.
Cale sought the Ombudsman’s immediate investigation of Cerdan.
Cale claims that he was forced to retire as municipal engineer of Anda on July 15, 2012, without waiting for his 65th birthday on Oct. 22, 2012, due to threats.
