DEMOLITION OF MALASIQUI MAGIC

FAILING to get justice from the local court, the complainant in a civil case against Malasiqui Mayor Armando Domantay et al. went to the Supreme Court to seek an order directing the immediate demolition of the building of Magic Malasiqui.

Mario Armas, the complainant, said he went to the Supreme Court because of the alleged refusal of Regional Trial Court Judge Renato Pinlac to issue a writ of demolition on the building of Magic after a judgment on the matter was already promulgated by the Court of Appeals.

It will be recalled that on April 20 last year, the CA reversed and set aside Municipal Ordinance No. 005-2003 and Municipal Resolution No. 002-2009 that legitimized the construction of the Magic building, declaring both as invalid and contrary to law.

Moreover, the lease contract entered into pursuant to the same was also declared null and void.

Armas said the entry of judgment on the said case was submitted before the court of origin presided over by Judge Pinlac.

Maintaining that the judgment had become final and executory on April 2, 2014, Armas said that the entry of judgment was submitted before the court of origin on September 1, 2004.

In his motion, Armas asked the Supreme Court to issue an order directing /compelling Judge Pinlac to issue a writ of demolition for the Sheriff to demolish the Magic Building with deliberate dispatch.  (Leonardo Micua)
