MC Adore sale declared null and void

THE Regional Trial Court (RTC) branch 40 through Judge Mervin Jovito Samadan has declared as null and void Resolution No. 6738-2002 approved by the Sangguniang Panlungsod of Dagupan on April 20, 2012 authorizing Mayor Benjamin Lim to negotiate for the sale of the MC Adore and the Calasiao properties.

The decision stemmed from the special civil action filed by Sangguniang Panlungsod Secretary Ryan Ravanzo questioning the validity of the resolution enacted by nine of 12 councilors of Dagupan during a special session held while Vice Mayor and SP presiding Officer Belen Fernandez was in the United States.

The 12-page decision penned by Judge Samadan on May 20, 2013 reads in part:: “This court is not ready to lend its approval to a course of action which would achieve one object of desire at the expense of the orderly administration of justice and observance of due process. Concededly, the challenged Resolution was enacted with the best of motive. But in spite of its virtuous aims, the enactment of the Resolution has no statutory authority to stand on. All told the court declares the Resolution in question invalid”.

Aside from Lim, the respondents in the petition were Councilors Jesus Canto, Ma. Librada Reyna, Karlos Liberato Reyna, Marc Brian Lim, Redford Christian Mejia, Luis Samson Jr. Alvin Coquia, Guillermo Vallejos and John Chester Gonzales.
