Principal contests dismissal before CA

CONTRARY to published reports that the Manaoag National High School principal has been dismissed, Mrs. Agnes Raguinan was not dismissed and remains the school’s principal to date.

Her stay was affected by her petition on Aug. 25, 2006 for the review on the decision of the Civil Service Commission (CSC) regional office which was affirmed by the CSC central office.

Represented by counsel Cansino, Cansino & Associates, Raguinan went to the Court of Appeals to seek a review of the decision in Administrative Case No. 2001-55 where she also prayed for the issuance of a Temporary Restraining Order enjoining the CSC and its deputies from implementing such decision.

She also sought that the writ of injunction on the CSC be made permanent and the decision as well as the resolutions promulgated by the CSC on the matter be also reversed and set aside and a new one be entered exonerating her on the offenses charged and dismissing the administrative complaint for lack of merit.

Raguinan, in a talk to The PUNCH, deplored the publication of the case in its August 27 issue saying it was a violation of Sec. 8 (Safeguards in Disciplinary Procedure) of Republic Act 4670 known as the Magna Carta for Public School Teachers, which states: “No publicity shall be given to any disciplinary action being taken against teachers during the pendency of his case.”

She said persons who peddled the information on the proceedings to the media acted in bad faith and with malice. She suspects a principal in a nearby town known to be aspiring to replace her was behind the smear campaign.

“As a matter of fact, according to RA 4670, any decision or preceding which is not initially tried or decided by the Department of Education is void ab initio”, Raguinan said.
